Terms of Service
Please read these terms carefully before using Ackmode. By signing up or subscribing to a plan, you agree to the conditions described here.
1. Parties and provider details
These terms govern the relationship between Ackmode (the "Provider") and the natural or legal person who signs up to the service (the "Customer").

2. Service description
Ackmode is a cloud service (SaaS) that lets appointment-based businesses (clinics, professionals, centres) manage:
- → WhatsApp reminders and appointment confirmations
- → Public booking page on the Customer's own subdomain
- → Google review requests when included in the contracted plan
- → Reactivation of inactive clients via WhatsApp when included in the contracted plan
- → Management panel with dashboard, appointments, no-shows and messages sent
The features included in each plan are described on the pricing page and inside the panel. Ackmode may roll out feature updates and improvements at any time without materially changing the purpose of the service.
3. Account and registration
- → Sign-up happens at /en/trial via the guided trial request form and a magic link sent by email.
- → The Customer must be of legal age and have the legal capacity to enter into contracts.
- → The Customer is responsible for the accuracy of the data provided and for the safekeeping of the panel access credentials.
- → An account may give access to several authorised users; the Customer is liable for actions performed under their account.
4. Guided 30-day trial
- → The trial is reviewed before activation. If the case fits the current product, Ackmode grants a free 30 calendar-day trial without requiring a credit card.
- → The trial does not auto-renew: if you do not subscribe to a plan when it ends, access is suspended and the data is kept for 12 months to allow reactivation.
- → Ackmode may limit features or quotas during the trial (for example, daily message volume) to prevent abuse.
5. Subscription and pricing
- → Current plans and prices are published at /en/pricing. Prices shown exclude VAT unless otherwise stated.
- → The subscription is monthly and renews automatically at the start of each period unless cancelled in advance.
- → The Customer can change plan at any time from the panel; the change applies on the next billing cycle.
- → Ackmode may change prices with at least 30 days' notice, without affecting the cycle in progress.
6. Payments and invoicing
- → Payments are processed through Stripe Payments Europe.
- → Invoices are issued at the start of each billing period and made available in the panel.
- → If a charge fails, Ackmode will retry it for up to 7 days. If the payment still does not go through, the account may be suspended until the situation is resolved.
- → Tax and billing information must be kept up to date in the panel.
7. Cancellation and refunds
- → The Customer may cancel the subscription at any time from the panel. Cancellation takes effect at the end of the current billing period.
- → There is no lock-in and no cancellation penalty.
- → Monthly fees are non-refundable except where required by applicable law. Consumer distance-selling rights apply where mandatory.
- → After cancellation, Customer data is kept for 12 months in case of reactivation. After that period it is deleted, except for legal retention obligations.
8. Acceptable use
The Customer agrees not to use Ackmode to:
- ✗ Send unsolicited commercial communications (spam) to people who have not given consent
- ✗ Send unlawful, deceptive or offensive content, or content that infringes third parties' rights
- ✗ Circumvent usage quotas or attempt to access unauthorised system resources
- ✗ Reverse-engineer, copy or redistribute the panel software
- ✗ Use the service for activities that breach applicable law, including data protection rules
Ackmode may suspend or close accounts that breach these rules, especially when the breach jeopardises the WhatsApp channel reputation used by other customers.
9. Customer data, GDPR and WhatsApp messaging
With respect to end-client data processed in the panel, Ackmode acts as Data Processor and the Customer as Data Controller. Processing details (sub-processors, international transfers, retention periods) are described in the Privacy Policy and in the DPA.
The Customer warrants that it has a valid legal basis to send messages to its end clients (consent, contractual necessity or another valid basis) and undertakes to honour opt-out requests received through any channel.
The default messaging provider is WhatsApp via QR session (Evolution). The Customer may optionally enable WhatsApp Business API (Meta) from the panel; in that case, Meta processes the messages under its own terms and policies.
10. Availability and support
- → Ackmode makes reasonable efforts to keep the service available 24/7, without committing to a specific SLA percentage unless agreed separately.
- → Planned maintenance interruptions may occur; they will be announced reasonably in advance whenever possible.
- → Ackmode is not liable for outages caused by third parties (Hetzner, Cloudflare, Stripe, Meta/WhatsApp), but cooperates to restore the service as soon as possible.
- → Support is provided by email (support@ackmode.com) and, on plans that include it, via WhatsApp.
11. Intellectual property
Ackmode, its software, brand, website and panel are the property of the Provider. The Customer receives a non-exclusive, non-transferable use right limited to the duration of the subscription.
Data entered by the Customer and data of the Customer's end clients always belongs to the Customer. Ackmode does not claim rights over that data beyond what is necessary to deliver the service.
12. Limitation of liability
To the maximum extent permitted by law, Ackmode's total liability to the Customer for any claim arising from the service is limited to the amount paid by the Customer during the 12 months preceding the event giving rise to the claim.
Ackmode is not liable for indirect damages, loss of profit or losses arising from the use or impossibility of use of third-party services (including, without limitation, Stripe, Meta/WhatsApp, Cloudflare or Google) that are integrated into the service but that the Provider does not operate.
13. Changes to these terms
Ackmode may update these terms to reflect legal, technical or service-related changes. Updates are published on this page with the corresponding "last updated" date. When changes are material, they are notified by email or from the panel with reasonable notice. Continued use of the service after the new terms take effect constitutes acceptance of them; if you disagree, you can cancel the subscription without penalty.
14. Governing law, jurisdiction and contact
These terms are governed by the laws of Spain. Mandatory consumer-protection rules of the consumer's country of residence also apply where applicable. Any dispute will be brought before the competent courts under applicable law; for business customers, the courts of Barcelona have exclusive jurisdiction.
