1. Who we are

Ackmode — Automation consultancy, Barcelona, Spain. We design and operate intelligent automation systems for appointment-based businesses. We operate primarily in Spain and across the EU. Contact: support@ackmode.com.

Ackmode has not designated a Data Protection Officer (DPO). For any privacy-related queries or to exercise your rights, contact us at support@ackmode.com. We will respond within 30 days.

2. What data we collect

• → Contact and account data — name, email address, phone number and business details you provide when requesting the guided trial or signing up as a customer.
• → Product usage data — activity inside the panel (appointments created, messages sent, configuration) required to deliver the service.
• → Browsing data — pages visited, time on site and referral source, collected anonymously via Cloudflare Web Analytics, with no personal identifiers stored.
• → Communication records — emails and messages you send to support, kept to manage our relationship with you.

3. How we use your data

• ✓ To process your guided trial request and, if the case fits, give you access to the panel.
• ✓ To deliver the service you have signed up for (appointment management, reminders, reviews and panel).
• ✓ To respond to your support enquiries.
• ✓ To send you account-related information or relevant service updates.
• ✓ To improve our website based on anonymous usage patterns.

We never sell your data to third parties, and we never use it for purposes unrelated to delivering the service.

4. Legal basis (GDPR)

We process your data under the following legal bases:

• → Contractual necessity — when you sign up for a plan or request the guided trial.
• → Legitimate interest — to provide support after an enquiry and improve the service.
• → Consent — for any marketing communications, which you can withdraw at any time.

6. Sub-processors (SaaS service)

When you sign up to Ackmode (paid plan or guided trial), we act as a Data Processor with respect to your end-clients' data processed in the panel. To deliver the service we use the following sub-processors:

7. International data transfers

Panel and end-client data is stored on servers located in the European Union (Hetzner, Germany).

Cloudflare and Stripe operate part of their infrastructure in the United States. Transfers are covered by the EU-US Data Privacy Framework, under which both are certified entities, and by Standard Contractual Clauses approved by the European Commission.

If you enable WhatsApp Business API (Meta) from the panel, messaging passes through Meta's infrastructure, which also combines Standard Contractual Clauses and the EU-US Data Privacy Framework to cover international transfers.

8. Cookies

This website uses Cloudflare Web Analytics, which requires neither cookies nor personal identifiers. We do not use advertising cookies or tracking pixels.

Inside the private panel we only use cookies that are strictly necessary to keep your session active and secure.

9. Guided trial request form (/en/trial)

When you complete the guided trial request form at /en/trial, we collect and process the following data:

• → Data collected: name, email address, phone number, business sector, number of professionals, and acceptance of this policy.
• → Purpose: to process the guided trial request and contact the user for onboarding and commercial follow-up.
• → Legal basis: explicit consent (Art. 6.1.a GDPR) and legitimate interest for commercial follow-up (Art. 6.1.f GDPR).
• → Retention: data is kept for the duration of the guided trial account plus 12 additional months after closure. Webhook logs are deleted after 30 days.
• → Recipients: our own infrastructure (panel.ackmode.com) and self-hosted n8n on EU servers. No international data transfers to third parties for this flow.
• → Rights: you may exercise your rights of access, rectification, erasure and objection by writing to support@ackmode.com.

10. Data retention

We keep your account data for as long as the service relationship lasts and, after closure, for as long as required to meet legal obligations (typically up to 6 years for billing data). If you request closure, we delete personal data not subject to legal retention within a maximum of 90 days. You may request deletion at any time by emailing support@ackmode.com.

11. Your rights

Under GDPR you have the right to:

• ✓ Access the personal data we hold about you
• ✓ Request correction of inaccurate data
• ✓ Request deletion of your data ("right to be forgotten")
• ✓ Object to or restrict our processing
• ✓ Data portability — receive your data in a machine-readable format
• ✓ Withdraw consent at any time (where processing is consent-based)

12. Changes to this policy

We may update this policy occasionally. When we do, we'll update the "last updated" date at the top of this page. Continued use of the site after changes constitutes acceptance of the updated policy.
